The following Privacy Policy has been prepared to describe the information we collect about you, how it is used, and whom we may or may not share it with. This policy covers the SimpleCert website and SimpleCert Software as a Service (SaaS) tool. This privacy policy has been compiled to better serve those who are concerned with how their ‘Personally identifiable information’ (PII) is being used online. PII, as used in US privacy law and information security, is information that can be used on its own or with other information to identify, contact, or locate a single person, or to identify an individual in context. Please read our privacy policy carefully to get a clear understanding of how we collect, use, protect or otherwise handle your Personally Identifiable Information in accordance with our website. If you do not agree with this Privacy Policy, or the Terms of Service, you may not use this Site, or the SimpleCert Service.

What personal information do we collect?

When registering for your free 2 week trial of SimpleCert, you will be asked to enter your name, email address, and other details. If you become a paid subscriber to SimpleCert, you will be asked to provide your credit card information, along with other billing information, and we will take steps to validate the credit card and billing information supplied to us to ensure it is accurate. We will retain your information for as long as your account is active, as needed to provide you services, to comply with our legal obligations, resolve disputes, and enforce our agreements. If you wish to cancel your account or request that we no longer use your information to provide you services, you can cancel your subscription through the Account Settings area of the SimpleCert tool. We do not share, sell, trade, or rent your personal information to third parties except as described in this privacy policy.

We may also gather generic information automatically to help gauge the effectiveness of our website and the SimpleCert SaaS tool. This generic information does not include any information that can be used to identify the user, but does provide us with what pages were visited and for what duration, number of pages viewed by a visitor, originating traffic sources, browser technical information and country of origin. This information is not shared or sold to a third party, and is used solely by SimpleCert to improve the content of our website for our visitors.

How do we use your information?

Information we collect from you when you subscribe to the service is used primarily to maintain your account and subscription to the SimpleCert service. We may also use the information we gather from you in the following ways:

  • To allow us to better service you in responding to your customer service requests.
  • To quickly process your transactions.
  • To send periodic emails regarding your subscription and other services, including cancelation of service requests and other correspondences.

 

How do we protect visitor information?

Our website is scanned on a regular basis for security holes and known vulnerabilities in order to make your visit to our site as safe as possible.
SimpleCert uses industry-standard efforts to safeguard the confidentiality of personally identifiable information, including encryption, firewalls and SSL (Secure Sockets Layer). Nevertheless, we remind you that no security measure is perfect.

SimpleCert is not liable for loss of passwords due to user carelessness. If you lose control over your password, you may lose control over your personally identifiable information. If you believe your password has been compromised, we recommend that you immediately change your password.

All financial transactions are processed through a gateway provider and are not stored or processed on our servers.

How can I review, correct and update my personal information?

If you wish to change or review your personal information, go to your Account Settings page. There you can access or update the personal information and account history we have on file.

Do we use ‘cookies’?

We do not use cookies for tracking purposes.

Third Party Disclosure

We do not sell, trade, or otherwise transfer to outside parties your personally identifiable information unless we provide you with advance notice. This does not include website hosting partners and other parties who assist us in operating our website, conducting our business, or servicing you, so long as those parties agree to keep this information confidential. We may also release your information when we believe release is appropriate to comply with the law, enforce our site policies, or protect ours or others’ rights, property, or safety.

California Do Not Track Disclosures

CalOPPA is the first state law in the nation to require commercial websites and online services to post a privacy policy. This law requires websites collecting personally identifiable information from California consumers to post a conspicuous privacy policy on its website stating exactly the information being collected and those individuals with whom it is being shared, and to comply with this policy. In addition and in conjunction with the regulations set forth by CalOPPA:

  • We honor do not track signals and do not track, or plant cookies when a Do Not Track (DNT) browser mechanism is in place.
  • We do not allow third party behavioral tracking.

How can I be informed of any changes to the SimpleCert Privacy Policy?

Any and all changes to this privacy policy will be published on this page. To review and stay informed of any changes to this policy and how they may affect you, you are advised to periodically visit this page.

Fair Information Practices

The Fair Information Practices Principles form the backbone of privacy law in the United States and the concepts they include have played a significant role in the development of data protection laws around the globe. Understanding the Fair Information Practice Principles and how they should be implemented is critical to comply with the various privacy laws that protect personal information.

In order to be in line with Fair Information Practices we will take the following responsive action, should a data breach occur:

  • We will notify the users via email within 7 business days
  • We will notify the users via in site notification within 7 business days.

We also agree to the individual redress principle, which requires that individuals have a right to pursue legally enforceable rights against data collectors and processors who fail to adhere to the law. This principle requires not only that individuals have enforceable rights against data users, but also that individuals have recourse to courts or a government agency to investigate and/or prosecute non-compliance by data processors.

CAN SPAM Act

The CAN-SPAM Act is a law that sets the rules for commercial email, establishes requirements for commercial messages, gives recipients the right to have emails stopped from being sent to them, and spells out tough penalties for violations.
We collect your email address in order to:

  • Send information, respond to inquiries, and/or other requests or questions pertaining to your subscription.
  • Provide you with an avenue to manage and authenticate your subscription to SimpleCert.
  • We may also send you additional information related to your subscription, and the SimpleCert SaaS tool.

To be in accordance with CANSPAM we agree to the following:

  • NOT use false, or misleading subjects or email addresses
  • 1Identify the message as an advertisement in some reasonable way
  • Include the physical address of our business or site headquarters
  • Honor opt-out/unsubscribe requests quickly
  • Allow users to unsubscribe by using the link at the bottom of each email

If at any time you would like to unsubscribe from receiving future emails from SimpleCert, you can follow the instructions at the bottom of each email and we will promptly remove you from all correspondence.

As per the Terms of Service, as a subscriber and user of SimpleCert you agree to abide and follow these same provisions as a part of the CAN SPAM Act.
